1. Your Responsibility for Uploaded Content
By using TapIt Solutions, you represent and warrant that you own, or have obtained all necessary rights, licences, permissions, and consents for any content you upload, submit, publish, generate, or ask TapIt Solutions or its artificial-intelligence features to process.
These rights may include copyright, trademark, privacy, personal-information, publicity, personality, name, image, portrait, likeness, voice, performer, and moral rights.
You are solely responsible for the legality, accuracy, integrity, and appropriateness of your uploaded content and for ensuring that TapIt Solutions is legally permitted to host, process, reproduce, modify, display, transmit, and otherwise use that content as required to provide the Services.
You must not use the Services to create, upload, modify, publish, advertise, promote, or distribute content that:
- infringes another person’s intellectual-property, privacy, personality, publicity, moral, contractual, or other legal rights;
- uses an identifiable person’s name, portrait, image, likeness, or voice for advertising, endorsement, or commercial promotion without valid authorization or consent;
- falsely represents that an individual, business, or organization created, approved, endorsed, sponsored, or is otherwise associated with content, a product, or a service;
- fraudulently impersonates another person or uses another person’s identity information to obtain an advantage, property, or benefit; cause a disadvantage; or support unlawful conduct;
- contains a deceptive synthetic image, video, audio recording, voice clone, digital replica, or other manipulated media intended or reasonably likely to mislead others about an identifiable person;
- includes personal information that you are not legally authorized to collect, use, disclose, upload, or provide to TapIt Solutions;
- violates applicable privacy, data-protection, copyright, trademark, defamation, consumer-protection, advertising, competition, or criminal laws; or
- is otherwise unlawful, fraudulent, deceptive, harmful, or prohibited by the TapIt Solutions Acceptable Use Policy.
2. British Columbia Privacy and Personality Rights
Where British Columbia’s Personal Information Protection Act applies, you must ensure that the collection, use, and disclosure of personal information is consented to or otherwise legally authorized, is limited to purposes that a reasonable person would consider appropriate in the circumstances, and complies with applicable notice and consent requirements.
British Columbia’s Privacy Act may create civil liability, without proof of damage, where a person’s name or portrait is used without consent to advertise or promote the sale of property or services. For this purpose, “portrait” includes a still or moving likeness and may include a disguised likeness or caricature.
3. Canadian Copyright and Impersonation Rules
Content must comply with Canada’s Copyright Act. You must obtain permission where required before using copyright-protected works. The statutory exception for non-commercial user-generated content applies only where all legal conditions are satisfied and the use is solely non-commercial; it should not be assumed to cover business advertising, promotions, or other commercial uses.
Fraudulent personation may constitute identity fraud under section 403 of Canada’s Criminal Code where it is carried out with a prohibited intent, including obtaining an advantage or property, causing a disadvantage, avoiding arrest or prosecution, or obstructing justice.
4. Enforcement
TapIt Solutions may investigate suspected violations and, where reasonably appropriate, may reject or remove content, restrict features, suspend or terminate accounts, preserve relevant records, and cooperate with lawful requests or orders from regulators, courts, or law-enforcement authorities.
You agree to indemnify and hold harmless TapIt Solutions and its affiliates, officers, directors, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from your uploaded content, your instructions to the Services, or your breach of this section, to the extent permitted by applicable law.
